TERMS OF USE

Effective Date: 1 APRIL 2026

1. INTRODUCTION

These Terms of Use (“Terms”) govern access to and use of the Dumkio Platform (the “Platform”), a digital real estate management system that facilitates interactions between landlords, tenants, property managers, and related stakeholders.

The Platform and all software, design, and content are owned by Dumkio Limited. Users are granted a limited, non-exclusive, non-transferable license to use the Platform. Users retain ownership of their uploaded content but grant the Platform a license to use it for service provision.

By downloading, installing or using the Dumkio Platform mobile application or web platform, you agree to be bound by these Terms with no amendments or edits. Any parties who do not agree with these terms should not use the Platform.

2. DEFINITIONS

  • “Platform” means the software, website, and mobile application operated by Dumkio.
  • “User” means any landlord, tenant, property manager, or third party using the Platform.
  • “Services” means property management tools including listings, rent tracking, communication, reporting, and related services.
  • “Content” means all data uploaded by Users including property details, personal data, and communications.

3. ELIGIBILITY

At sign-up all users of the Platform should provide accurate and complete information. Users must also be over 18 years of age and have the legal capacity to contract under the Law.

4. NATURE OF THE PLATFORM

4.1

The Platform is a technology intermediary for use by landlords, agents, tenants and other stakeholders and does not:

  • Own, lease, or manage property;
  • Act as an agent, broker, or fiduciary (unless expressly agreed in writing);
  • Guarantee rental payments, tenant performance, or property condition.

4.2

All agreements between landlords and tenants are independent contracts between those parties.

5. USER ACCOUNTS

Upon registration on the platform, each user shall provide KYC information for the creation of a user account. The Platform owner warrants to use this information only as consented to by the users. Users must maintain confidentiality of login credentials and are responsible for all activities under their accounts.

Users are responsible for maintaining account confidentiality and must notify the platform owner if any unauthorised use of their accounts.

Dumkio may suspend or terminate accounts for breach of security concerns.

Dumkio reserves the right to terminate any user accounts for breach with or without notice to the user.

6. USERS

6.1 USER OBLIGATIONS

Users agree to:

  • Provide accurate property and personal information;
  • Comply with all applicable Kenyan laws (including landlord-tenant laws);
  • Not upload false, misleading, or unlawful content;
  • Not use the Platform for fraud, harassment, or illegal activity.

Any breach of the above would result in personal liability of the user and removal from the platform.

6.2 USER CONTENT AND CONDUCT

Users may upload content including listings, tenant details and communications. The Users agree not to;

  • Post false, misleading or fraudulent information.
  • Infringe intellectual property rights of any party.
  • Harass, abuse or harm others.
  • Use the platform for unlawful purposes.

7. PAYMENTS AND TRANSACTIONS

7.1

The Platform may facilitate rent payments or service fees but,Dumkio does not guarantee payment completion and is not responsible for failed, delayed, or reversed transactions by tenants.

7.2

Payment processing may be handled by third-party providers.

8. DATA PROTECTION AND PRIVACY

8.1

The Platform processes personal data in compliance with the Data Protection Act, 2019.

8.2

In accordance with the Act:

  • Data is processed lawfully, fairly, and transparently;
  • Users consent to collection and processing of their data;
  • Users have rights to access, correction, and deletion of data.

8.3

Users agree:

  • Not to misuse personal data of other users;
  • To comply with data protection obligations when acting as landlords or agents.

Any violation of these clauses will result in personal liability on the infringing party.

9. THIRD-PARTY SERVICES

The Platform may integrate with: Payment providers, utility services, communication tools to provide services on the platform, Dumkio is not liable for the failure or downtime of any third-party services.

10. DISCLAIMER OF WARRANTIES

The Platform is provided “as is” with no additions to the platform, the platform owner reserves the right to amend, add, or remove features to the platform without notice to any of the users.

To the fullest extent permitted by Kenyan law, no warranties are given regarding accuracy, reliability, or availability of the platform or any features therein.

The Platform does not guarantee: tenant suitability, property condition, continuous system uptime

11. LIMITATION OF LIABILITY

11.1

To the maximum extent permitted by law, the Platform Owner shall not be liable for:

  • Indirect, incidental, or consequential losses;
  • Loss of income, rent, profits, or business opportunities;
  • Data loss or system downtime;
  • Disputes between landlords and tenants.

11.2

In the event of any claim on which the Platform, its owners or operators are found liable, the total liability shall not exceed the total fees paid to the platform in the preceding 3 months.

11.3

The Platform shall not be liable for:

  • User-generated content;
  • Fraud, misrepresentation, or breach by Users;
  • Force majeure events.

12. INDEMNITY

Users agree to indemnify and hold harmless the Platform Owner against the following:

  • Claims arising from user content;
  • Breach of these Terms;
  • Violation of law or third-party rights.

13. TERMINATION

The Platform may; Suspend or terminate access without notice for breach and/or remove content that violates the terms contained herein.

Users may terminate their account at any time after which their user information would be deleted as requested except that required to be retained by law.

14. DISPUTE RESOLUTION

The parties shall first attempt by mediation between the parties. Thereafter if there is no resolution, the matter shall be filed in a court of competent jurisdiction in the country of the platform’s operation.

15. FORCE MAJEURE

The Platform shall not be liable for delays caused by events beyond reasonable control including: Internet outages, government actions or natural disasters

16. MODIFICATIONS

The Platform may update these Terms at any time and will give 7 days notice of any such changes to the Users. In any instance, continued use of the Platform constitutes acceptance of any updated Terms of use.

17. GOVERNING LAW

These Terms shall be governed by the laws of Kenya.
